Юридическое лицо в праве Древнего Рима и средневековой Сербии

Abstract

На основе многопланового анализа источников римского частного права и юридических источников средневековой Сербии X—XV вв. исследуется становление и развитие института юридического лица в праве Древнего Рима и средневековой Сербии. Автор проанализировал историю создания, структуру и содержание понятия юридического лица в эпоху Древнего мира и Средневековья, а также особенность механизма рецепции структурных элементов юридического лица в праве Древнего Рима и средневековой Сербии, которые оказали существенное влияние на формирование современного гражданского права стран романо-германской правовой системы.

Based on the multifaceted analysis of the Roman private law and Serbian juridical sources of the 10th–15th centuries, the study of the evolution of the institution of the legal entity in the law of Ancient Rome and medieval Serbia was carried out. The author has analyzed the history of creation, the structure and contents of the notion of legal entity in the epoch of the Ancient World and Middle Ages, as well as the peculiarity of the mechanism of adopting the structural elements of the legal entity in the Ancient Roman private law and the law of Medieval Serbia that exerted considerable influence on the formation of modern civil law of the countries with the Roman-Germanic legal system.
